PERGESERAN PARADIGMA DESENTRALISASI PENDIDIKAN NASIONAL: STUDI KOMPARATIF UU No. 22 TAHUN 1999 dan UU No. 23 TAHUN 2014

Abstract

The post-reform transformation of Indonesia's government system has significantly impacted educational governance through decentralization policies. This research aims to analyze the concept of national education decentralization from the perspectives of Law No. 22 of 1999 and Law No. 23 of 2014, examine the fundamental differences in the distribution of authority between the two, and evaluate the impacts and challenges of implementing the transfer of authority to the provincial level. The method employed is a literature study with a descriptive qualitative approach. The results indicate a paradigm shift from broad autonomy under Law No. 22 of 1999, which granted extensive authority to regencies/cities, toward controlled decentralization under Law No. 23 of 2014 through the distribution of concurrent affairs. A significant change is observed in the transfer of secondary education management to provincial governments to strengthen oversight and quality standardization. Although decentralization enhances regional flexibility and community participation, practical challenges persist in the form of resource disparities between regions, bureaucratic complexity, and coordination of educator distribution. This research concludes that strong synergy between central and regional governments is essential to ensure the effectiveness of equitable national education governance
