Abstrak
Penelitian ini mengkaji pertanggungjawaban pidana anak sebagai pelaku persetubuhan terhadap anak dengan fokus pada Putusan Nomor 1/Pid.Sus-Anak/2024/PN RAP. Sistem peradilan pidana anak di Indonesia mengutamakan prinsip keadilan restoratif, di mana pidana dijadikan upaya terakhir (ultimum remedium). Hal ini dilakukan dengan tujuan untuk dapat memastikan anak yang berhadapan dengan hukum tetap mendapatkan perlakuan yang mendukung pembinaan dan rehabilitasi demi masa depannya. Di sisi lain, tindak pidana oleh anak dapat dilakukan terhadap anak juga. Oleh karena itu, permasalahan yang dikaji meliputi dasar hukum yang mengatur pertanggungjawaban pidana anak terhadap anak dan analisis terhadap pertimbangan hakim dalam menjatuhkan putusan. Adapun penelitian ini dilakukan dengan menggunakan metode yuridis normatif dengan pendekatan studi kasus. Data diperoleh dari bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa dasar hukum pidana anak sebagai pelaku persetubuhan terhadap anak mencakup Pasal 76D, Pasal 81 ayat (1), dan Pasal 81 ayat (2) Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak, dengan penilaian berdasarkan subjek, unsur kesalahan, dan keakuratan alat bukti. Pertimbangan hakim mencakup aspek yuridis, sosiologis, dan fisiologis, serta cukup mengacu pada prinsip ultimum remedium menurut UU SPPA. Putusan berupa pidana penjara 2 tahun 3 bulan dan pelatihan kerja 3 bulan dan berbagai pertimbangan hakim mencerminkan usaha dalam menerapkan prinsip tersebut. Namun melalui pertimbangan dan putusan tersebut, dinilai kurang memerhatikan masa depan bagi korban sebagai anak.

Abstract
This research examines the criminal responsibility of children as perpetrators of sexual intercourse with children with a focus on Decision Number 1/Pid.Sus-Anak/2024/PN RAP. The juvenile criminal justice system in Indonesia prioritizes the principle of restorative justice, where punishment is used as a last resort (ultimum remedium). This is done with the aim of ensuring that children in conflict with the law continue to receive treatment that supports development and rehabilitation for their future. On the other hand, criminal acts by children can be committed against children too. Therefore, the issues studied include the legal basis that regulates criminal responsibility for children and an analysis of the judge's considerations in making decisions. This research was conducted using normative juridical methods with a case study approach. Data was obtained from primary and secondary legal materials. The research results show that the criminal legal basis for children as perpetrators of sexual intercourse with children includes Article 76D, Article 81 paragraph (1), and Article 81 paragraph (2) of Law Number 35 of 2014 concerning Child Protection, with an assessment based on the subject, elements of error, and accuracy of evidence. The judge's considerations cover juridical, sociological and physiological aspects, and simply refer to the principle of ultimum remedium according to the SPPA Law. The decision was a prison sentence of 2 years and 3 months and 3 months of work training and the judge's various considerations reflected efforts to apply this principle. However, through these considerations and decisions, it was deemed that they did not pay enough attention to the victim's future as a child.
