JUAL BELI PUPUK DENGAN SISTEM PAKET DI KECAMATAN SIMPANG SEMADAM, ACEH TENGGARA PERSPEKTIF WAHBAH AZ-ZUHAILI

Salah satu kebutuhan petani adalah pupuk subsidi, di Kecamatan Simpang Semadam para petani dipaksa agen untuk membeli pupuk dengan sistem paket gabungan pupuk subsidi dan nonsubsidi. Padahal petani tidak terlalu membutuhkan pupuk nonsubsidi pembelian pupuk dengan sistem paket harus mengeluarkan biaya yang lebih besar. Tujuan penelitian ini untuk mengetahui mengapa terjadi penjualan pupuk bersubsidi dengan sistem paket, bagaimana pengaturan jual beli pupuk subsidi di Indonesia dan bagaimana jual beli pupuk bersubsidi dengan sistem paket di Kecamatan Simpang Semadam Perspektif Wahbah Az-Zuhaili. Jenis penelitian adalah yuridis empiris dengan pendekatan living case studies, conceptual approach dan statute approach. Sifat penelitian ini deskriptif analisis, data dikumpulkan melalui wawancara, observasi dan studi dokumen. Data dianalisis dengan metode kualitatif. Hasil dari penelitian menunjukan faktor penjualan pupuk bersubsidi dengan sistem paket karena penumpukan barang di gudang, penjualan pupuk bersubsidi diatur melalui Peraturan Menteri Pertanian Pasal 14 No. 10 tahun 2022 mengenai mekanisme pengalokasian pupuk bersubsidi. Hukum jual beli pupuk bersubsidi dengan sistem paket Perspektif Wahbah Az-Zuhaili tidak sah karena ada unsur paksaan.

Abstract

One of the needs of farmers is subsidized fertilizer. In Simpang Semadam District, farmers are forced by agents to buy fertilizer using a combined package system of subsidized and non-subsidized fertilizer. Even though farmers don’t really need non-subsidized fertilizer, purchasing fertilizer using a package system requires higher costs. The aim of this research is to find out why there is sale of subsidized fertilizer using a package system, how the sale and purchase of subsidized fertilizer is regulated in Indonesia and how the sale and purchase of subsidized fertilizer uses a package system in Simpang Semadam District from Wahbah Az-Zuhaili’s perspective. The type of research is empirical juridical with a living case studies approach, conceptual approach and statute approach. The nature of this research is descriptive analysis, data was collected through interviews, observation and document study. Data were analyzed using qualitative methods. The results of the research show that the sales factor for subsidized fertilizer using a package system is due to the accumulation of goods in warehouses. The sale of subsidized fertilizer is regulated through Minister of Agriculture Regulation Article 14 No. 10 of 2022 regarding the mechanism for allocating subsidized fertilizer. The law on buying and selling subsidized fertilizer using the Wahbah Az-Zuhaili Perspective package system is invalid because there is an element of coercion.
